Introduction: These Terms of Use for all Users apply to your access and use of MyRoomz and your agreement with us. These Terms of Use for all Users, the Terms of Use for Fans and the Terms of Use for Creators, the Acceptable Use Policy, the Referral Program Terms and the Complaints Policy are collectively referred to as the Terms of Use.
Capitalized terms used in these Terms of Use but not defined have the meanings given in the other agreements or policies incorporated into these Terms of Use.
In the event of inconsistency, between the Terms of Use and the other agreements or policies these Terms of Use prevail.
Interpretation: In these Terms of Service:
"MyRoomz" refers to our website, including when accessed via the URL http://www.myroomz.co/;
"we", "our", "us" means MyRoomz Pty Ltd;
“Business Day” means any day that is not a Saturday, Sunday or public holiday in Western Australia;
"Content" encompasses all material uploaded to MyRoomz by any User (Creator or Fan), including photos, videos, audio, livestreams, data, text, metadata, images, interactive elements, emojis, GIFs, memes, and more;
"Creator" denotes a User who has configured a MyRoomz account to post Content for others to view;
"Fan" signifies a User who follows a Creator and can access the Creator's Content;
"Fan/Creator Transaction" encompasses transactions between a Fan and Creator on MyRoomz, granting access to Content, such as through Subscriptions, pay-per-view Content payments, or interaction functions on a Creator's account;
"Fan Payment" includes payments made by a Fan to a Creator for transactions or as tips;
"Referring User" refers to a User part of MyRoomz Referral Program;
"Standard Contract / Agreement between Fan and Creator" are the terms for each Fan/Creator Transaction, available (Standard Agreement Between Fan and Creator)
"Subscription" describes a Fan's subscription to a Creator's account, paid or unpaid, one-time or bundled for multiple months;
Tax means any present or future tax, GST, levy, impost, deduction, withholding, charge, duty, fee or rate imposed or collected by or on behalf of a government, tax or revenue authority (including penalties, interest and other amounts imposed in connection with any of the foregoing), in any jurisdiction, but does not include tax on MyRoomz’s own income
"Terms of Service" (also "your agreement with us") encompasses various legal documents as amended, updated or replaced from time to time binding you and us:

Any other supplemental policies or notices issued by MyRoomz from time to time.
"United Kingdom" means Great Britain and Northern Ireland;
"User" includes anyone using MyRoomz, whether as a Creator, Fan, or both ("you" or "your").
Who we are and how to contact us: MyRoomz is managed by MyRoomz Pty Ltd 56 Palmerston St Perth WA 6000 Australia, email our support team at support@myroomz.co or write to us at our registered office address.
Changes to the Terms of Service: We may amend, update or replace the Terms of Service at any time due to regulatory changes or security risks with or without prior notice to you. Any such amendment, update or replacement will take effect immediately upon being posted on the MyRoomz platform or otherwise made available to you. Your continued use of the services after the effective date constitutes acceptance of the revised Terms of Service. rep. To the maximum extent permitted by law:
We and our agents, directors, employees and public officers are not liable to you for any loss or damage arising from a change to the Terms of Service made by us; and
you waive any right to claim that a change to the Terms of Service is invalid on the basis that prior notice was not given to you.
MyRoomz changes and availability: Updates and changes to MyRoomz might occur at any time for any reason, such as reflecting changes to our services, business practices, regulatory requirements or for security improvements. We'll aim to notify you of significant changes. Continual availability of MyRoomz or any Content is not guaranteed, and we may suspend or withdraw parts of the service as needed.
Registering with MyRoomz:
6.1 Register and Create
To use MyRoomz, register and create an account providing a valid email, username, and password, or sign in using Twitter or Google. Passwords should be unique and meet MyRoomz's technical requirements. To register, you must:
be at least 18, or older if required by your country/state laws to be bound by a contract with us,
legally permitted by your country/state to join MyRoomz and view its Content, and
provide other information or verifications as we require including in relation to any regulatory requirements.
Your Commitments to Us: As a User of MyRoomz, you are obliged to the following:
If you previously had a MyRoomz account, you affirm it was not terminated or suspended by us for breaching any terms or policies.
The information you provide to us will be honest, precise, and complete.
Any changes to your submitted information will be updated promptly.
You agree to receive electronic communications, including emails and messages on your MyRoomz account, and consent to the processing of your personal data as outlined in our Privacy Policy.
You will maintain the confidentiality and security of your account details, including user information and passwords. If you suspect unauthorized use of your account or a security breach, promptly contact support@myroomz.co. Ensure you log out after every session, especially when on public/shared computers to prevent unauthorized access to your personal information.
You are liable for all activities under your account, whether or not you have permitted such use.
Adhere to the MyRoomz Terms of Use for All Users, our Acceptable Use Policy, and all other sections of the Terms of Service as applicable.
Our Rights, Including Suspension or Termination of Your Account:
We are not responsible for monitoring or reviewing your Content for compliance with the Terms of Service or applicable laws, this is your responsibility.
Our policy allows us to suspend access to Content that may not comply with the Terms of Service or laws while we investigate. If such a case arises, you can seek a review by reaching out to support@myroomz.co. Post-investigation, we may act as deemed appropriate, including reinstating or permanently deleting the Content without your consent or notice. You agree to provide reasonable and prompt assistance in such investigations at your own expense.
If your Content is suspended or deleted, we'll notify you through email or a message to your MyRoomz account, but prior notice of suspension or deletion isn't guaranteed.
We reserve the right to terminate your agreement and access to MyRoomz with a 30-day notice via email or a message to your account. Immediate suspension or termination without notice v may occur if we determine you engage in any illegal activity, you seriously or repeatedly breach the Terms of Service or act against our interests or reputation.
Further we may determine an immediate suspension without notice is appropriate while we review a complaint or a takedown notice or in relation to AML CTF Compliance.
Upon account termination, we may manage your Content as per our Privacy Policy, which may include deletion, and you will not have access to your Content.
We may probe into suspected or actual misuse, illegal use, or abuse of MyRoomz and cooperate with law enforcement if needed.
We may release any of your usage records or information to law enforcement as part of an investigation, to safeguard our interests, or in adherence to legal processes.
The payment providers for transactions on MyRoomz can be changed, and if so, we'll inform you and update relevant details on your MyRoomz account.
Except for Content (owned/licensed by Creators), all rights to MyRoomz's contents, features, databases, and functionality belong to us and our licensors, protected by copyright and other intellectual property laws.
We retain all rights to anonymized data from your use of MyRoomz, which we can use for various purposes, including commercial, development, and research.
What We Are Not Responsible For: While we endeavor to maintain a high standard of service with MyRoomz, there are specific areas where we assume no responsibility or liability, including:
We do not endorse or validate any Content on MyRoomz, and the views expressed by Creators or Fans do not reflect our own.
We do not grant rights regarding Content; any rights may be granted by Creators only.
If you are recognizable from your Content, we and our agents, directors, employees and public officers are not liable for any identification resulting from it. We may offer geofencing or geolocation technologies, but we do not guarantee their effectiveness or accuracy, and we're not accountable for your reliance on them.
Users create, select, and supply all Content. We do not review or moderate Content, nor are we required to monitor it for violations of the Terms of Service.
Following any User's suggestions, comments, or instructions is at your sole risk, with no obligation to do so.
No guarantees are made that Creators or Referring Users will earn any specific amounts of money through MyRoomz.
Materials provided on MyRoomz for Users are for general information and come with no assurances regarding accuracy or potential outcomes.
We do not promise compatibility of MyRoomz with all devices or operating systems. It's your responsibility to ensure proper setup and virus protection for accessing MyRoomz.
We are not accountable for internet connectivity issues, errors in your devices, or any issues related to your use of MyRoomz.
While we aim for a secure platform free from bugs and viruses, we make no guarantees and do not control Content provided by Creators.
We bear no responsibility for lost, stolen, or compromised User accounts or passwords, nor for any unauthorized use or transactions as a result.
Once Content is shared on MyRoomz, we are not able to control how it may be used by others, and we are not to blame if it's used inappropriately even if your account is deleted.
Intellectual Property Rights – Ownership, and Licenses:
10.1 Your IP and Moral Rights
You assert ownership of all intellectual property rights in your Content or confirm you have all the necessary rights for the licenses you grant to us and other Users.
You grant us a license to use your Content for any purpose related to the operation of MyRoomz, which includes reproduction, distribution, public display, translation, and creation of derivative works.
The license you give us is perpetual, non-exclusive, worldwide, free of royalties, and can be sublicensed, assigned, or transferred. It remains in effect even after you stop using MyRoomz or your agreement with us ends. We may add watermarks, stickers, or text to your Content, share it with other Users, and use it for normal operations of MyRoomz, but we will not sell it to other platforms.
While we don't own your Content, we have the right to file copyright infringement notices on your behalf. We are not obliged to police infringements of your Content.
You waive any moral rights to object to derogatory treatment of your Content under relevant laws, which does not affect your ownership of intellectual property rights or rights to prevent unauthorized copying of your Content.
Our IP
Ownership of Platform Materials
The Platform, and all content, features and functionality made available by or on behalf of us (including the MyRoomz name and logo, layouts, look-and-feel, templates, workflows, text, graphics, icons, photographs, audio, video, streams, compilations, databases, underlying source code, software and APIs) (together, MyRoomz Materials) are owned by or licensed to us and are protected by Australian and international copyright, trade mark and other intellectual property laws.
Except for the limited, revocable, non-transferable licence expressly granted to you in these Terms of Use to access and use the Platform for its intended purpose, no rights, title or interests in or to the MyRoomz Materials are transferred to you.
Restrictions on UseYou must not, and must not permit any person to:
copy, reproduce, modify, adapt, translate, create derivative works from, display, perform, publish, distribute, transmit, sell, resell, rent, lease, sub-license, exploit or otherwise deal with any MyRoomz Materials, other than as expressly permitted in these Terms of Use;
remove, obscure or alter any copyright, trade mark or other proprietary notice appearing on or in connection with the Platform;
use any data-mining, robots or similar data-gathering or extraction tools to access the Platform (other than as permitted by a public search engine on a non-commercial basis); or
register, apply for, or claim any intellectual property right that is identical or confusingly similar to any MyRoomz trade mark, brand, domain name or other identifier.
Protection and Enforcement
We may monitor use of the Platform to detect unauthorized use of the MyRoomz Materials.
Where we reasonably believe that your use of the Platform or any content you have uploaded infringes or may infringe the intellectual property rights of MyRoomz or any third party, we may
remove or disable access to the relevant content;
suspend or terminate your account;
withhold or set off any payouts or other amounts payable to you; and/or
report the matter to law enforcement or other relevant authorities.
You agree to cooperate with us, at our cost, in protecting and enforcing our intellectual property rights, including by providing reasonable information about suspected infringement of any MyRoomz Materials.
User Infringement Indemnity
To the maximum extent permitted by law, you indemnify us and our agents, directors, employees, and public officers (Indemnified Parties) against all loss, liability, damage, cost and expense (including legal costs on a full indemnity basis) suffered or incurred by the Indemnified Parties arising out of or in connection with any claim that content uploaded, posted, streamed or otherwise made available by you on or through the Platform infringes the intellectual property or moral rights of any person or infringes the MyRoomz Materials.
No Challenge
You must not challenge, or assist any other person to challenge, the validity or ownership of the MyRoomz Materials or of any intellectual property right owned or licensed by us.
Twitter Integration: Users can link an active Twitter account to their MyRoomz account and share Content to Twitter. If using this feature, you must also adhere to Twitter's terms of service.
Linking to and from MyRoomz:
You may link to the MyRoomz homepage.
Links from MyRoomz to third-party sites are provided for convenience only; we accept no responsibility for their content nor for any associated loss or damage.
Use of domain names involving MyRoomz trademarks must comply with specific guidelines and obtain prior written permission from us.
For more details or permission regarding trademark domain names, please contact support@myroomz.co. Non-compliance with these guidelines or a licensing agreement may lead to a domain dispute claim.
Deleting Your Account: To terminate your MyRoomz account, you can do so from the 'User Account' section within your MyRoomz settings.
As a Fan, your account will be deactivated within a reasonable time after your request.
As a Creator, your account will stay active until your Fans' subscription periods end, after which you will receive your last payment before account deletion.
If you're both a Fan and Creator, the deletion process occurs in two phases – first as a Fan, then as a Creator.
Post-deletion, you will no longer be charged, have access to your former MyRoomz account or its Content, and all subscriptions will cease. An email confirmation will verify the successful deletion of your account. Your Content may be handled appropriately, including deletion, as stated in our Privacy Policy.
Limitation of Liability for Loss or Damage:
Notwithstanding any other provision of the Terms of Service and to the maximum extent permitted by law, we and our agents, employees, directors and public officers are not liable for indirect, incidental, or consequential loss or damage relating to or arising from (in whatever manner) your use or another’s use of the MyRoomz platform.
Nothing in these Terms of Use excludes, restricts, or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (ACL) or other applicable law that cannot be excluded.
For services not of a kind ordinarily acquired for personal, domestic, or household use, we and our agents, employees, directors and public officers total liability is limited, at our option, to re-supplying the services or paying the cost of having the services re-supplied.
For all other claims, we and our agents, employees, directors and public officers total liability for loss is capped at the greater of:
$5,000.00 AUD; and
the total fees paid by you to us in the 6 months preceding the claim.
e. Some of the indirect, incidental or consequential loss or damage we and our agents, directors, employees and public officers are not liable for include:
Lost profits, sales, business, or revenue.
Interruptions to your business.
Missed savings.
Lost business opportunities, goodwill, or reputation.
Data or Content loss.
damages from cyber threats or any Content infringement by others; and
- We and our agents, directors, employees and public officers are not liable or responsible for identity exposure, private information leaks without consent, or non-performance due to events beyond our control.
The obligations under this clause 14 survive termination of this Agreement.
AML/CTF Compliance
We uses third party payment providers (including Bankful) that are subject to the Anti Money Laundering and Counter Terrorism Financing Act 2006 (Cth) and related regulations. By using the platform, you agree to:
provide accurate and complete identification and payment information when requested for compliance purposes;
cooperate with any reasonable request from us or our payment providers in relation to AML/CTF checks;
acknowledge that payouts or transactions may be delayed, suspended, or withheld where verification is incomplete, suspicious activity is detected, or as required by law; and
consent to the disclosure of your information to AUSTRAC or other regulators where legally required.
We may suspend or terminate your account if you fail to comply with these requirements or if required by its payment providers or applicable law.
Hierarchy of Documents
These Terms of Use, together with the Privacy Policy, Community Guidelines, Consent for Intimate Images Policy, Copyright Infringement and Takedown Policy, Appeal Policy, ESG Policy, and any other policies published by Us (collectively, the “Terms of Service”), form the entire agreement between you and Us.
In the event of any inconsistency or conflict between the Terms of Service, the following order of precedence applies (with the higher‑ranked document prevailing to the extent of the inconsistency):

Where a specific policy expressly states that it prevails in relation to a particular subject matter (for example, the Consent for Intimate Images Policy in relation to intimate content), that statement will apply notwithstanding the hierarchy above.
Indemnity: You agree to indemnify and hold us and our agents, directors, employees, and public officers (Indemnified Parties) harmless from and against all claims, damages, losses, liabilities, costs, and expenses (including legal costs on a full indemnity basis) suffered or incurred by any of the Indemnified Parties arising out of or in connection with
your breach of these Terms of Service;
any negligent, unlawful or willful act or omission by you in connection with these Terms of Service or your use of the MyRoomz platform; and
any claim by a third party arising from your breach of the Terms of Service.
Survival: The obligations under this clause 16 survive termination or expiry of these Terms of Use.
Governing Law: These Terms of Use are governed by the laws of Western Australia and where applicable the laws of the Commonwealth of Australia. You submit to the exclusive jurisdiction of the courts of Western Australia and where applicable the Commonwealth of Australia.
Prohibited Conduct
Users must not:
Upload unlawful, defamatory, or infringing content.
Engage in harassment, fraud, or impersonation.
Circumvent platform security or payment systems.
General Terms:
Severance: if any part of the Terms of Service is or becomes void or unenforceable then that part will be severed from these Terms of Service so that all parts that are not now or do not become void or unenforceable will remain in full force and effect and be unaffected by any severance.
Rules of Interpretation
The rules of interpretation contained in this clause apply to the interpretation of the Terms of Service except where the context makes it clear that a rule is not intended to apply;
Where a word or phrase is given a particular meaning, other parts of speech and grammatical forms of that word or phrase have corresponding meaning;
Headings are for convenience only and do not affect interpretation of these Terms of Service;
A reference to a party includes that party’s executors, administrators, personal representatives, successors and assigns and if a party comprises two or more persons, the executors, administrators, personal representatives, successors and assigns of each of those persons;
If a party comprises two or more persons, the covenants and agreements on their part bind them, must be observed and performed by them, jointly and severally and may be enforced against any one or more of them;
A singular word includes the plural and vise versa.
If an example is given of anything (including a right, obligation or concept), such as by the use of the word “includes” or “including”, the example does not limit its scope;
A reference to “cost” or “costs” means, on a full indemnity basis, costs, losses, liability, charges, expenses, fees, imposts, levies, duties, taxes, overheads, administrative costs, salaries and other amounts lawfully incurred or imposed (including fines and penalties).
A provision in the Terms of Service is not to be construed against a party merely because that party was responsible for the instructions for the preparation of these Terms or any part of them.
Entire Agreement: The Terms of Service contain the entire agreement between the parties and supersedes all prior negotiations, representations, proposals, undertakings and agreement, whether written or oral, relating to the subject matter of the Terms of Service.
Waivers
failure to exercise or delay in exercising any right, power or privilege in these Terms does not operate as a waiver of that right, power or privilege;
a single or partial exercise of any right, power or privilege does not preclude:
any other or further exercise of that right, power or privilege; or
the exercise of any other right, power or privilege.
Assignment and Delegation: We may:
assign our rights under the Terms of Service and if we do so we will inform you within 20 Business Days of assignment; and
delegate performance of our obligations under the Terms of Service.
Indemnity:
Any indemnity from you to us specified in the Terms of Service survives the termination or expiration of our agreement for you to access the MyRoomz platform.
Introduction: These terms of use for Fans are additional terms (Fan Specific Terms) that apply when you engage with the MyRoomz platform as a Fan. These Fan Specific Terms form part of the overarching agreement you have with us.
Interpretation: In these Fan-specific Terms, terms defined in the general Terms of Use for all Users retain their meaning. Additional definitions include:
"Tax" as the meaning given in the Terms of Use for all Users.
Additional terms for Using MyRoomz: By using MyRoomz, you're agreeing to:
The Terms of Use for all Users.
Our Privacy Policy, which informs how your data is handled.
The Acceptable Use Policy, outlining permitted MyRoomz uses.
Our Complaints Policy, detailing our complaint resolution process.
The Standard Contract between Fan and Creator, dictating individual transaction terms (not part of your agreement with us).
Community Guidelines, offering extra conduct and interaction rules on MyRoomz; and
Any other policies or terms made available on our platform or otherwise provided to you as updated, amended or replaced from time to time,
(collectively known as our Terms of Service).
Other applicable Terms:
If you're also a Creator, the Creator-specific Terms apply to you in that role.
Those in the MyRoomz referral program must follow the Referral Program Terms.
Your Obligations:
Confirm you're over 18 or meet the legal contract age per your local law.
Provide additional information and age and identity verification as requested.
Ensure legal compliance in the jurisdiction you are located to join MyRoomz and engage with its Content.
Have the means and intent to make necessary payments for Content you wish to access.
General Content Terms:
You pledge that all Content you contribute to MyRoomz:
Adheres to our overarching Terms of Service, chiefly the Acceptable Use Policy.
Is your intellectual property or you're licensed to use it in the manner required.
In case it integrates third-party material, you've secured all necessary rights and consents.
You indemnify us and will compensate us for any claims, demands, losses, liabilities, costs and expenses arising from your non-compliance with the above terms.
We do not endorse User Content and are not bound to oversee it, nor do we control its composition.
Adult Content Acknowledgment: You are informed that some MyRoomz Content is adult-oriented, and you should carefully consider where and how you view that Content. We and our agents, directors, employees and public officers are not liable for any repercussions, or loss or damage you may incur by accessing the Content, particularly if it infringes any third-party agreements or laws you are or may be subject to.
Terms for Subscriptions and Purchases by Fans: This section outlines the conditions for transactions between Fans and Creators:
Fan/Creator interactions are founded on the Standard Contract between Fan and Creator. While MyRoomz provides the platform and stores Content, we are not a party to that Standard Contract or any other agreements between Fans and Creators.
Creators retain full discretion to set prices for Fan/Creator Transactions within the MyRoomz pricing parameters. All pricing is displayed in USD.
Additional Tax may be applied to Fan Payments as appropriate.
To proceed with a transaction with a Creator, you must link a payment method to your account and select 'Subscribe' on the chosen Creator's profile.
By making a purchase, you authorize us and our affiliates to share your payment details with external payment processors to handle the Fan Payment. Payments, made in USD, may attract additional currency conversion charges by your bank or card issuer, over which we and our affiliates have no control and hold no responsibility.
If multiple payment methods are on file and the initial card fails, alternate provided cards will be charged the full amount.
Periodic Subscription fees will be deducted automatically, along with immediate charges for any other payments (like tips), with consent granted for each transaction via your provided payment method.
Subscriptions, excluding free trials, renew automatically unless your payment method declines, the subscription rate increases, or you turn off "Auto-Renew" on the Creator's profile. To discontinue subscriptions, the "Auto-Renew" toggle on the Creator's profile must be switched off.
Canceling a Subscription allows access to the Creator's Content until the current period ends, with no further charges post-cancelation for that Creator's profile, unless you resubscribe.
Refrain from making baseless refunds or chargeback claims on transactions or tips to Creators. If such claims are thought to be in bad faith, we reserve the right to suspend or delete your account. We may also recover from you, by set-off or direct debit, any processor fees, scheme fines or administrative costs we incur because of your chargeback or dispute.
Wallet Credits: You may advance funds into MyRoomz (called "Wallet Credits") for future transactions. When your Wallet Credits fall short of a purchase cost, your payment card will be fully charged. There is a set maximum for Wallet Credits, and they will not accrue interest. These credits are non-refundable and non-redeemable for unused balances.
Suspension of Your Account: Should your account be suspended as per our Terms of Service rights, all pending Fan Payments will also be suspended for the duration of your account's suspension.

Interpretation: Within these Creator Specific Terms, definitions are consistent with those in the Terms of Use for all Users, plus:
"Tax" as the meaning given in the Terms of Use for all User.
Additional Terms for Your Use of MyRoomz: By using MyRoomz, you're agreeing to:
The Terms of Use for all Users;
Our Privacy Policy, detailing personal data usage;
The Acceptable Use Policy, which informs what is permissible on MyRoomz;
The Complaints Policy, outlining complaint resolution;
The Standard Contract between Fan and Creator which sets Fan/Creator Transaction terms (not part of your agreement with us);
Our Community Guidelines, providing further interaction rules on MyRoomz; and
Any other policies or terms made available on our platform or otherwise provided to you.
as updated, amended or replaced from time to time (collectively known as our Terms of Service).
Other Applicable Terms: Your use of MyRoomz may also be governed by:
Fan Specific Terms, if you also interact as a Fan;
Referral Program Terms, if you participate in the MyRoomz Referral Program.
Creator Fee Structure: MyRoomz levies a fee of 10% on all Fan Payments (excluding any Tax), termed 'Our Fee.' This allows for the upkeep and operation of MyRoomz. The remaining 90% of the Fan Payment (excluding Tax) is designated as your 'Creator Earnings.' Our Fee is subtracted from the Fan Payment, with Creator Earnings paid as described in the Payouts section.
Account Setup for Creators: To create a Creator account, you must:
Provide a valid government issued ID and photographs in accordance with the outlined requirements here.
Enter bank or payment method details on your User account page.

Personal Legal Responsibility of Creators: Each Creator is personally responsible under the Terms of Service. Agents or third parties assisting with your account do not lessen your responsibility. Legal obligations fall on you, the Creator, for any account activity.
Fan/Creator Transactions: The following outlines terms for Fan/Creator Transactions:
All Fan/Creator Transactions are agreements between Fans and Creators based on the Standard Contract between Fan and Creator. While MyRoomz facilitates these by offering the platform and content storage, we are not a contract party and hold no responsibility for these transactions.
Fan Payments are Tax-exclusive, with the appropriate rate added as necessary.
Upon confirmation of a Fan/Creator Transaction, fulfill your duties (e.g., permit Content viewing, provide paid Content, interact with Fans as paid). You agree to compensate us for any failures to meet these obligations, ensuring we're covered for any resulting losses or damages. We may satisfy any such amount by setting it off against your Creator Earnings, Wallet Credits or any other amount we hold for you.
Content – General Terms: Beyond the Terms of Service, particularly our Acceptable Use Policy, these terms apply to Content you post on MyRoomz as a Creator:
Your Content isn't confidential, and you give permission to your Fans to access and view it on MyRoomz for lawful and personal use.
You guarantee every piece of Content you post on MyRoomz:
aligns with the Terms of Service, specifically our Acceptable Use Policy;
you have all rights necessary to use and license your Content on MyRoomz, including rights for all territories and jurisdictions with your Fans;
you own or are licensed to use and share your Content with your Fans;
for Content that includes third-party material, you have all required rights, consents, and releases for its use on MyRoomz;
Content must be:
of commendable quality according to the description, price, and other relevant factors, including claims about its nature;
fit for any declared purpose which Fans have mentioned;
as described by you.
You are responsible to us and indemnify us for any claim, demand, loss, liability, cost and expense arising from any warranty in section 9(b) being false.
We do not endorse nor are we accountable for any aspect of Content posted by you or another User. We have no duty to monitor Content and do not control its substance.
You acknowledge and agree that you are, and will remain, the sole custodian of records in respect of all Content you upload to the MyRoomz platform. As custodian of records, you are solely responsible for:
(i) maintaining and retaining any records required by law in relation to the Content;
(ii) ensuring the accuracy, authenticity, and legality of such records; and
(iii) producing such records to competent authorities if lawfully required.
we do not assume, and we expressly disclaim, any obligation to act as custodian of records for your uploaded Content.
Advertising on MyRoomz: Any video Content for promoting third-party goods or services you post on MyRoomz:
Must follow the rules listed in sections 10(b) and (c).
Requirements for Advertising Content: Verify that any such Content:
doesn't:
harm human dignity;
endorse discrimination;
promote risky health or environmental behavior;
cause any detriment to individuals;
exploit inexperience or credulity;
manipulate trust;
depict undue risky situations;
steers clear of promoting tobacco, illegal drugs, prescription meds, or unlawful gambling;
in relation to alcoholic promotions, must not target minors or provoke excessive drinking; and
is not illegal.
Transparency for Advertising Content: Clearly indicate Content as advertising by labeling with #ad prior to posting.
Co-authored Content: For shared Content displaying others besides yourself:
You affirm each person is a verified adult and Consents to be in the Content, with documentation ready to provide at our request.
You have written Consent from each person for their appearance in the Content and for its use on MyRoomz.
If the Co-Authored Content includes others with MyRoomz Creator accounts, tag those identifiable accounts.
If the Content is jointly created, you must procure relevant rights from co-authors to allow its MyRoomz availability.
Payments are made solely to the uploading account. You are responsible for any revenue sharing with displayed individuals. We are not responsible for private revenue-sharing agreements, and you hold no earning rights for Content posted on another Creator’s account. Failure to provide legal information upon request may result in Content removal, account suspension or termination, or withheld payments.
We and our agents, directors, employees and public officers are not liable to you in relation to, and you indemnify us from, any claims, demands, losses, liabilities, costs and expenses arising from any Co-Authored Content and you understand that any such claims should be directed at the posting Creator(s) or appearing individuals and not us.
Payouts to Creators:
Fan Payments are received by an external payment processor approved by us from time to time and may change without notice.
If you use Bankful Payout Option, it will collect Fan Payments and disburse your Creator Earnings to your bank.
If using another Payout Option, we or our affiliated companies will deduct Our Fee and hold your Creator Earnings for you.
Your MyRoomz account will reflect your Creator Earnings within a reasonable time, and these will be withdrawable once displayed in your account.
Withdrawals require a minimum amount, which varies by country and Payout Option, visible on the Banking page in your account.
The 'current balance' in your account denotes your Creator Earnings at that time. All financial transactions are in AUD. With Bankful, conversions are made to your local currency based on Bankful’s exchange rates. Banks or e-wallet services may charge conversion or access fees, which are outside our and our affiliates' control and responsibility.
Should a Fan receive a successful chargeback or refund, we may deduct the equivalent Creator Earnings from your account after investigation.
We do not retain details from your payout registration with third-party providers, except for direct bank transfers.
Withholding Creator Earnings:
We may withhold any part of the Creator Earnings due for breaches of the Terms of Service, threats thereof with serious potential consequences, or if linked to illegal or fraudulent activities, until an investigation is complete. If our findings confirm such breaches or illegal activity, you could forfeit your Creator Earnings.
If subject to liens, we may withhold any part of the Creator Earnings until the lien is resolved. We have no obligation to pay lienholders.
We and our agents, directors, employees and public officers are not liable to you for withholding or forfeiture of your Creator Earnings if we are acting accordance with the Terms of Service.
If portions of withheld Creator Earnings are deemed unrelated to breaches or suspected unlawful activity, we may release these to you. However, we may retain any or all Creator Earnings should your breaches result in any loss or damage to us.
Should investigation conclude earnings are to be forfeited, we will aim to refund the corresponding Fan Payments (when legally permissible) to the Fans directly.
Intellectual Property Rights – Ownership, and Licenses:
You assert ownership of all intellectual property rights in your Content or you confirm you have all the necessary rights for the licenses you grant to us and other Users.
You grant us a license to use all intellectual rights in your Content for any purpose related to the operation of MyRoomz, which includes reproduction, distribution, public display, translation, and creation of derivative works, and otherwise make available on MyRoomz’s platform.
The license you give us is perpetual, non-exclusive, worldwide, free of royalties, and can be sublicensed, assigned, or transferred by us. The license remains in effect even after you stop using MyRoomz or your agreement with us ends. We may add watermarks, stickers, or text to your Content, share it with other Users, and use it for normal operations of MyRoomz, but we will not sell it to other platforms.
While we don't own your Content, we have the right to file copyright infringement notices on your behalf. We are not obliged to police infringements of your Content.
To the maximum extent permitted by law you waive any moral rights to object to derogatory treatment of your Content,
Tax Compliance and GST (Goods and Services Tax)
General Advice:
All Creators are strongly encouraged to seek independent professional tax advice to ensure compliance with Australian tax laws, including GST obligations under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
By using MyRoomz as a Creator, you confirm that you have and will continue to report all income earned via the Platform to the Australian Taxation Office (ATO) or relevant tax authority in your country of residence and register for GST where applicable.
You are solely responsible for your tax affairs. If you discover any non-compliance with tax obligations relating to your MyRoomz income, you must notify us in writing at [tax@myroomz.co] within 7 days of discovery. Your notice must include details of the issue, any corrective actions taken, and any further information we may reasonably require.
We do not provide tax, legal, or financial advice. We are not responsible for your failure to meet tax, legal or financial obligations or for any reliance placed on general information provided by us, in the Terms of Services or through the Platform.
We reserve the right to suspend or terminate your Creator account if we become aware of non-compliance with your taxation obligations or failure to cooperate withAustralian tax requirements.
GST and Australian-Based Creators:
For GST purposes, MyRoomz acts as an intermediary and payment processor between Creators and Fans, but Creators are responsible for billing and remitting GST where required.
In general terms, if you are an Australian tax resident and are required to be registered for GST (i.e. you earn $75,000 AUD or more per year from all business income, including MyRoomz earnings), you must:
Register for GST with the ATO;
Ensure your account details include your ABN and GST registration status;
Include GST in the pricing of your content or subscriptions as required.
Where applicable, Creators may issue their own Recipient Created Tax Invoices (RCTIs) or allow us to do so on their behalf under an RCTI agreement, if such an
If you are GST-registered, you must ensure your earnings are correctly accounted for in your Business Activity Statements (BAS) submitted to the ATO.
Creators below the GST threshold are still required to monitor their income and register for GST when required. If we identify that your platform earnings exceed the GST threshold, we may notify you and request your GST details.
Failure to provide GST registration information upon request, or failure to comply with ATO requirements, may result in the suspension or termination of your account.

This Policy applies to your use of MyRoomz and all Content on MyRoomz and is integral to your agreement with us. It outlines acceptable and unacceptable conduct on MyRoomz.
Definitions used in this Policy carry the same meanings as those in our Terms of Use for all Users.
MyRoomz is for your personal use only. Do not sell, rent, transfer, or share your account or the Content you obtain from MyRoomz with anyone else.
Use MyRoomz legally and appropriately.
Do not post Content that is illegal, fraudulent, defamatory, hateful, discriminatory, threatening, harassing, violent, or indicative of illegal activity.
Do not engage in activity that exploits or harms individuals.
When uploading Content to MyRoomz, the Content must not:
Feature anyone under the age of 18 or any other individuals unless you have verified they are at least 18 and you have obtained their Consent in accordance with the Terms of Service.
Depict or promote illegal or restricted items such as weapons or drugs; self-harm; suicide; incest; bestiality; non-consensual acts; extreme sexual acts; violence; or "revenge porn.
Contain unsolicited sexual content or degrading language directed at other Users without Consent.
Include hate speech or incitement or discrimination against any individual or group.
Involve sharing another person's private or confidential information without explicit Consent.
Include public nudity recorded in jurisdictions where it is illegal or sexual acts performed in public view.
Appear to be endorsed by us or any other party without proper authorization.
Cause unnecessary inconvenience, anxiety, or is likely to offend others.
Be used for blackmailing or extracting money or other benefits in exchange for Content removal.
Promote third-party commercial activities or sales without our express Consent.

Do not use MyRoomz to stalk, bully, abuse, harass, threaten, or intimidate anyone.
Avoid engaging in conduct that is deceitful or likely to deceive other Users on MyRoomz.
Respect the intellectual property rights of Creators; do not distribute their Content without permission.
Do not infringe upon our or anyone's rights, including intellectual property, personality rights, competition, privacy, and data protection.
Do not impersonate MyRoomz staff, Users, or entities, nor claim unverified associations.
Provide accurate information upon account creation and do not misuse others' Content or data.
Do not disseminate spam, manipulatively increase interactions, or share inauthentic or low-quality Content.
Do not present pre-recorded material as live content or use MyRoomz to distribute such material.
Avoid using alternative methods to share Content prohibited by this Policy.
Do not reproduce or redistribute Content beyond the scope allowed by the Terms of Service.
Refrain from introducing harmful or malicious material into Content.
Do not attempt to reverse engineer or derive the source code of MyRoomz.
Use MyRoomz in a manner that does not compromise system security or other Users' experiences.
Do not use automated programs to access MyRoomz or to extract or harvest information.
The use of MyRoomz's branding should adhere strictly to the Terms of Service or our written Consent.
Violations of this policy can result in account suspension, termination, and revoked access to earnings as detailed in the Terms of Service.

Submitting a Complaint: To voice a complaint regarding MyRoomz (be it about Content or a User's behavior), contact us at support@myroomz.co with your name, address, contact details, and a clear description of your issue. Handling Illegal or Non-consensual Content Complaints: Upon receiving a complaint of illegal or non-consensual Content we will act in accordance with the Terms of Service including:
We will take steps we deem appropriate to investigate the complaint in a timely manner.
Should we require more information from you, we’ll reach out.
We aim to investigate in good faith within seven (7) Business Days.
If we find the content to be unlawful or non-consensual, it will be removed immediately, and you'll be informed.
If we decide the Content is lawful and consensual, we will communicate our conclusion to you. For disputes over non-consensual Content, we will involve a neutral arbitrator at our expense.
Copyright Infringement: Please refer to our Copyright Infringement and Takedown Policy for copyright infringement issues. We follow that policy in responding to such complaints.
Handling Other Types of Complaints: For other complaints:
We will take appropriate steps to explore your concerns quickly.
We may contact you for additional information if needed.
Our actions to address the issue will be taken in good faith. If your complaint pertains to content that breaches our Acceptable Use Policy, we will swiftly remove it.
We are not required to disclose the outcome of your complaint to you.
Frivolous or Harmful Complaints: As a MyRoomz user, you agree not to make unjustified, abusive, or bad-faith complaints. If we find you have violated this agreement, it could lead to the suspension or termination of your account.
