Version: 2.0 Enterprise Governance Edition IMPORTANT LEGAL NOTICE THIS STREAMING POLICY GOVERNS ALL LIVESTREAMING, LIVE VIDEO, LIVE AUDIO, LIVE CHAT, STREAM INTERACTIONS, STREAM MONETISATION, STREAM RECORDS, STREAM MODERATION, LIVE AUCTIONS, LIVE ENGAGEMENT FEATURES AND RELATED STREAMING FUNCTIONALITY OPERATED THROUGH THE MYROOMZ PLATFORM. BY ACCESSING, VIEWING, HOSTING, PARTICIPATING IN OR OTHERWISE USING STREAMING FUNCTIONALITY ON THE PLATFORM, YOU ACKNOWLEDGE AND AGREE THAT: YOU HAVE READ THIS STREAMING POLICY; YOU UNDERSTAND THIS STREAMING POLICY; YOU AGREE TO BE LEGALLY BOUND BY THIS STREAMING POLICY; YOU UNDERSTAND THAT STREAMS MAY INCLUDE USER-GENERATED CONTENT, AI-ASSISTED SYSTEMS, MODERATION SYSTEMS, CREATOR INTERACTIONS AND THIRD-PARTY INFRASTRUCTURE; YOU ACKNOWLEDGE THAT STREAMS MAY EXPERIENCE INTERRUPTIONS, FAILURES, LATENCY, MODERATION ACTIONS OR OPERATIONAL ISSUES; YOU UNDERSTAND THAT MYROOMZ DOES NOT GUARANTEE CONTINUOUS STREAMING AVAILABILITY; YOU ACKNOWLEDGE THAT STREAMS MAY BE MODERATED, RESTRICTED, SUSPENDED OR TERMINATED WITHOUT PRIOR NOTICE WHERE REASONABLY NECESSARY; AND YOU ACKNOWLEDGE THAT MYROOMZ MAY PRESERVE STREAM-RELATED METADATA, CHAT RECORDS, TRANSACTIONAL DATA, MODERATION RECORDS AND ASSOCIATED OPERATIONAL DATA FOR MODERATION, COMPLIANCE, FRAUD PREVENTION, SAFETY OR LEGAL PURPOSES. IF YOU DO NOT AGREE TO THIS STREAMING POLICY, YOU MUST IMMEDIATELY CEASE USING STREAMING FUNCTIONALITY ON THE PLATFORM. 1. PLATFORM OPERATOR 1.1 Platform Operator The Platform is operated by: New Myroomzco Pty Ltd ABN: 21 698 117 476 PO BOX 136 APPLECROSS WA 6953 (“MyRoomz”, “we”, “our” or “us”) 1.2 Intellectual Property Ownership Certain livestream systems, moderation systems, messaging systems, AI systems, operational infrastructure and associated intellectual property connected with Platform streaming functionality may be owned by, licensed from or associated with: COLLAB IP HOLDINGS PTY LTD ACN: 698 248 967 PO BOX 136 APPLECROSS WA 6953 2. NATURE OF STREAMING FUNCTIONALITY 2.1 Streaming Services The Platform may provide livestream functionality including: live video streaming; live audio streaming; livestream messaging; livestream tipping; livestream auctions; subscriber-only streams; creator broadcasts; AI-assisted engagement systems; moderated livestream systems; and monetised live interaction systems. 2.2 Entertainment and Engagement Nature Streaming functionality is intended primarily for: entertainment; creator engagement; fan interaction; livestream monetisation; creator branding; digital interaction; and community engagement. 2.3 Independent Creator Operation Creators operate independently and remain solely responsible for: livestream conduct; livestream content; creator behaviour; moderation decisions; creator compliance obligations; creator taxation obligations; creator broadcasts; and compliance with applicable laws. 3. STREAM ACCESS AND ELIGIBILITY 3.1 Minimum Age Requirement Users must be at least 18 years old to: access livestream functionality; host livestreams; participate in livestream chat; purchase livestream access; tip creators during streams; or otherwise utilise streaming systems. 3.2 Creator Eligibility Creators may only access livestream functionality where: their Account remains active; verification requirements are satisfied; monetisation access remains operational; moderation restrictions are not active; and livestream privileges have not been suspended. 3.3 Fan Eligibility Fans may access livestream systems where: their Account remains active; payment systems remain operational; moderation restrictions are not active; and livestream access has not been restricted. 4. STREAM CONTENT RULES 4.1 Prohibited Stream Content Users must not utilise livestream systems for: unlawful conduct; child exploitation; non-consensual content; coercive conduct; unlawful solicitation; exploitative material; fraud; threats; blackmail; harassment; unlawful gambling; prohibited scams; hate speech where prohibited by law; unlawful violence; or conduct breaching Platform rules. 4.2 Creator Responsibility Creators remain solely responsible for: livestream material; creator statements; creator conduct; creator interactions; creator moderation; third-party appearances in streams; and compliance with laws applicable to livestream content. 4.3 AI and Delegated Systems Streams may involve: AI-assisted moderation; delegated staff moderation; creator assistants; livestream managers; operational support personnel; and automated moderation systems. 5. STREAM MODERATION 5.1 Moderation Rights MyRoomz may, at its sole discretion and without prior notice: interrupt livestreams; pause livestreams; remove livestreams; restrict livestream visibility; suspend livestream functionality; freeze livestream monetisation; preserve livestream records; investigate livestream activity; suspend creators; or terminate Accounts where reasonably necessary for: moderation; fraud prevention; User safety; payment-provider compliance; operational integrity; legal compliance; or platform protection. 5.2 Real-Time Moderation Livestreams may be monitored through: manual moderation; AI-assisted moderation; behavioural systems; automated moderation systems; livestream reporting systems; and operational moderation tools. 5.3 User Reporting Users may report: livestream conduct; livestream content; livestream chat; harassment; scams; impersonation; prohibited conduct; or policy breaches. 6. STREAM MONETISATION 6.1 Livestream Monetisation Features Creators may monetise livestreams through: subscriptions; livestream tips; auctions; pay-per-view access; Goal Contributions; Treat Contributions; and approved monetisation systems. 6.2 No Revenue Guarantees MyRoomz does not guarantee: livestream earnings; viewer counts; discoverability; algorithmic visibility; monetisation success; engagement levels; or commercial outcomes. 6.3 Payment Restrictions MyRoomz may: freeze livestream revenue; delay payouts; investigate monetisation; restrict monetisation access; or reverse transactions where reasonably necessary for moderation, fraud prevention or compliance purposes. 7. LIVESTREAM AUCTIONS 7.1 Auction Functionality Creators may conduct livestream auctions involving: digital Content; creator interactions; collectibles; merchandise; creator items; or approved goods. 7.2 Auction Moderation MyRoomz may: pause auctions; remove auctions; suspend bidding; preserve bidding history; freeze auction payouts; or investigate auction conduct where reasonably necessary for moderation, fraud prevention or operational integrity. 8. RECORDING, STORAGE AND STREAM DATA 8.1 Stream Recording Position MyRoomz does not generally retain livestream video or audio recordings following the conclusion of a livestream. 8.2 Metadata Retention MyRoomz may preserve: livestream timestamps; livestream metadata; moderation logs; livestream chat logs; AI interaction logs; monetisation activity; livestream analytics; bidding history; behavioural analytics; and operational records. 8.3 Evidence Preservation MyRoomz may preserve stream-related information where reasonably necessary for: moderation; fraud prevention; investigations; legal compliance; child safety; payment disputes; operational integrity; or law enforcement cooperation. 9. STREAM CHAT AND USER INTERACTIONS 9.1 Chat Rules Users must not utilise livestream chat systems for: harassment; threats; blackmail; spam; scams; unlawful conduct; prohibited solicitation; hate speech where unlawful; doxxing; or exploitation. 9.2 Creator Interaction Limitations Fans acknowledge and agree that: creators may not respond personally; creators may utilise delegated staff; creators may utilise AI systems; creators may engage with large audiences simultaneously; and livestream interactions are entertainment-focused systems only. 10. PLATFORM LIMITATIONS 10.1 No Guaranteed Availability MyRoomz does not guarantee: uninterrupted streaming; uninterrupted audio; uninterrupted video; uninterrupted monetisation; uninterrupted chat functionality; uninterrupted auctions; uninterrupted livestream access; or uninterrupted operational performance. 10.2 Operational Risks Users acknowledge risks associated with: internet failures; cloud-provider outages; livestream latency; infrastructure failures; moderation interruptions; payment-provider outages; operational failures; and technical disruptions. 11. WATERMARKING, SECURITY AND ANTI-PIRACY 11.1 Anti-Piracy Systems MyRoomz may utilise: visible watermarking; invisible watermarking; metadata tracking; fingerprinting systems; behavioural monitoring; anti-piracy systems; and operational analytics for moderation and enforcement purposes. 11.2 Recording Restrictions Users must not: record livestreams; reproduce livestreams; redistribute livestreams; commercially exploit livestreams; bypass Platform protections; or remove watermarking systems. 11.3 Platform Limitation MyRoomz cannot guarantee prevention of: screenshots; screen recordings; external recording devices; piracy; or unauthorised redistribution. 12. AI SYSTEMS AND AUTOMATED FEATURES 12.1 AI-Assisted Streaming Systems Streaming systems may involve: AI moderation; AI interaction systems; AI analytics systems; automated moderation systems; behavioural systems; and operational automation systems. 12.2 AI Limitations AI systems may: generate inaccurate moderation outcomes; fail to detect prohibited conduct; produce inconsistent results; evolve operationally; or experience interruptions. MyRoomz does not guarantee perfect AI moderation accuracy. 13. FRAUD PREVENTION AND INVESTIGATIONS 13.1 Investigation Rights MyRoomz may investigate: livestream activity; monetisation behaviour; auction conduct; payment disputes; livestream scams; livestream manipulation; moderation evasion; and operational anomalies. 13.2 Evidence Preservation MyRoomz may preserve: livestream metadata; chat history; moderation logs; transaction records; AI logs; IP information; behavioural analytics; and operational records for moderation, investigations, fraud prevention or legal compliance. 14. TAXATION AND GST 14.1 Creator Responsibility Creators remain solely responsible for: taxation obligations; GST obligations; reporting obligations; invoicing obligations; and compliance with taxation laws. 14.2 No Tax Advice MyRoomz does not provide: taxation advice; accounting advice; financial advice; or legal taxation advice. Users should seek independent professional advice. 15. DISCLAIMER OF PLATFORM RESPONSIBILITY MyRoomz does not guarantee: creator conduct; livestream quality; creator behaviour; viewer engagement; monetisation outcomes; livestream continuity; uninterrupted operational performance; or creator availability. Users acknowledge that livestream participation involves operational, financial, technological and interpersonal risks. 16. LIMITATION OF LIABILITY To the maximum extent permitted by law: MyRoomz excludes all implied warranties relating to livestream functionality; MyRoomz is not liable for livestream interruptions; MyRoomz is not liable for creator conduct; MyRoomz is not liable for User interactions; MyRoomz is not liable for monetisation outcomes; MyRoomz is not liable for livestream recording by third parties; MyRoomz is not liable for operational outages; and MyRoomz is not liable for indirect or consequential loss arising from livestream participation. Nothing excludes rights which cannot lawfully be excluded under Australian Consumer Law. 17. FORCE MAJEURE MyRoomz is not liable for livestream interruptions or operational failures arising from: cyber attacks; infrastructure outages; internet failures; cloud-provider failures; payment-provider failures; government actions; regulatory changes; natural disasters; or events beyond reasonable control. 18. TERMINATION AND SURVIVAL MyRoomz may suspend or terminate streaming functionality at any time where reasonably necessary for moderation, compliance, fraud prevention, operational integrity or platform protection. The following survive termination: moderation rights; evidence preservation rights; liability limitations; dispute rights; compliance obligations; and indemnities. 19. GOVERNING LAW This Streaming Policy is governed by the laws of: Western Australia; and the Commonwealth of Australia. Users submit to the jurisdiction of the courts of Western Australia. 20.
