Standard Agreement Between Fan and CreatorMyRoomz Pty LtdABN: 11 680 004 988 | 56 Palmerston Street, Perth WA 6000
Effective Date: 1 January 2026
This Agreement sets out the legally binding terms between you (“Fan”) and the Creator you subscribe to, interact with, or purchase Content from via the MyRoomz platform. MyRoomz Pty Ltd (“MyRoomz”, "we", "us") provides the infrastructure but is not a party to this Agreement. This Agreement is governed by Australian law and intended for use solely within Australia.
Although MyRoomz is not a party to this Agreement, the parties acknowledge and agree that MyRoomz is an intended third-party beneficiary of this Agreement and may rely on, enforce or take the benefit of any provision of this Agreement which
(a) limits MyRoomz’s liability;
(b) permits MyRoomz to withhold, suspend, review or remove Content or payouts; or
(c) requires the Fan or the Creator to indemnify or cooperate with MyRoomz.”
This Agreement is subject to the Terms of Use, Privacy Policy, and Community Guidelines of MyRoomz. In the event of inconsistency, the Terms of Use prevail, except where this Agreement expressly allocates rights between Fan and Creator.
To the extent this Agreement allocates rights only between Fan and Creator, those allocations do not bind MyRoomz.
Words used as defined terms in this Agreement but not defined take their meaning from the Terms of Use.
By using MyRoomz to access or purchase Creator Content, the Fan agrees to be bound by these terms. The Creator agrees that they are entering into a binding contract directly with the Fan.
Fan: A User who pays to access Content from a Creator.
Creator: A user who uploads, sells, or streams Content on MyRoomz and accepts payments from Fans.
MyRoomz Pty Ltd: An Australian-based platform operator that facilitates the transaction.
GST: Goods and Services Tax under Australian law.
Bankful: Third-party PCI DSS Level 1-compliant payment processor.
When a Fan makes a payment to access a Creator’s Content:
A direct contractual relationship is formed between Fan and Creator.
MyRoomz acts solely as an intermediary to process payments via Bankful.
The Creator receives 90% of the transaction, with 10% received by MyRoomz as a platform service fee.
MyRoomz may amend the Creator Earnings percentage or applicable fees at any time in accordance with the Terms of Use.
Creators are responsible for determining if they are required to register for GST.
MyRoomz will provide Creator reports for income tracking but will not withhold income tax.
Fans acknowledge that the displayed price may include GST, where applicable.
Creators must declare during onboarding whether they are GST-registered and are solely responsible for remitting GST.
By purchasing Content, Fans receive a limited, non-transferable, non-sublicensable licence to view that Content for personal, non-commercial use. This license does not permit:
Reproduction or redistribution
Public display or sharing
Resale of the content
All intellectual property rights remain with the Creator.
Creators represent that:
They own or hold necessary licenses for all Content.
They have obtained clear, voluntary and documented consent and legal release from any persons appearing in their Content.
They will not infringe on copyright, trademarks, or third-party rights of any other person.
Either party may terminate this Agreement with 14 days’ notice. The Fan’s license to access Creator Content terminates if:
The Fan’s account is suspended or terminated
The Creator removes or restricts access to their Content
MyRoomz ceases to operate the platform
The Fan engages in any fraud, breach of the terms of this Agreement or illegal activity
Refunds are not guaranteed upon content removal. MyRoomz may, but is not obliged to, facilitate refunds or partial credits to Fans and may recover any such amount from the relevant Creator’s future payouts.
Creators agree to:
Ensure uploaded Content is lawful, consensual, and compliant with MyRoomz policies
Not upload any Content involving individuals under 18 years of age
Clearly communicate pricing and terms of service to Fans
Maintain privacy and confidentiality of Fan data
Pass Know Your Customer (KYC) verification to operate on the platform
Fans agree to:
Be at least 18 years old and provide valid government issued identification documents if requested
Not share, screenshot, or record Creator Content without permission
Not harass, abuse, or threaten Creators or other Users
Comply with the MyRoomz Privacy Policy and applicable Australian law
Violation of these terms may result in account suspension, termination or legal action.
Payments are processed through MyRoomz’s payment provider.
Refunds are not available except in cases of fraud, duplicate charges or as required by Australian Consumer Law. Fans may cancel subscriptions at any time via their account settings. Cancellations take effect at the end of the billing period.
If a dispute arises between a Fan and a Creator:
Parties agree to first attempt resolution through MyRoomz’s internal resolution process.
If unresolved, either party may pursue the matter in the appropriate Western Australian Court
MyRoomz is not liable for Content-related disputes between a Fan and a Creator but may assist in facilitating communication.
Fans acknowledge that initiating a chargeback without valid grounds may result in account suspension or termination.
Creators acknowledge that payouts may be withheld or reversed where a chargeback, dispute or fraud investigation is opened in relation to the underlying Fan Payment..
In the event of a chargeback or fraudulent transaction:
The Creator may be required to provide evidence of delivery or interaction
Repeated or fraudulent activity may lead to account suspension or termination or referral to law enforcement
MyRoomz may provide evidence to a payment processor or card scheme on behalf of the Creator, but is not obliged to do so and makes no guarantee that a chargeback will be reversed.
MyRoomz may terminate or suspend accounts for:
Breach of this Agreement
Uploading illegal or non-consensual content
Safety concerns, fraud, or harassment
Repeated complaints or legal notices
other illegal activities
Content and earnings may be withheld where a breach is confirmed.
MyRoomz uses third‑party payment providers (including Bankful) that are subject to the Anti‑Money Laundering and Counter‑Terrorism Financing Act 2006 (Cth) and related regulations. By using the platform, you agree to:
provide accurate and complete government issued identification and payment information when requested for compliance purposes;
cooperate with any reasonable request from MyRoomz or its payment providers in relation to AML/CTF checks;
acknowledge that payouts or transactions may be delayed, suspended, or withheld where verification is incomplete, suspicious activity is detected, or as required by law; and
consent to the disclosure of your information to AUSTRAC or other regulators where legally required.
MyRoomz may suspend or terminate your account if you fail to comply with these requirements or if required by its payment providers or applicable law.
The Fan and the Creator each acknowledge that MyRoomz is not a party to this Agreement and has no responsibility for the creation, delivery, lawfulness, consensual nature or quality of any Content or interaction between them. Each of the Fan and the Creator indemnifies MyRoomz against any claim, loss, liability, cost or expense arising out of or in connection with their use of the Platform to enter into or perform this Agreement, except to the extent caused by MyRoomz’s wilful misconduct.
This Agreement is governed by the laws of Western Australia and applicable Australian Federal Law.
This Agreement may be updated from time to time. Continued use of the platform constitutes acceptance.
If any provision is invalid under law, the remaining terms shall remain in effect.
