Version: 2.0 Enterprise Governance Edition IMPORTANT LEGAL NOTICE THIS DATA RETENTION POLICY GOVERNS THE COLLECTION, STORAGE, RETENTION, ARCHIVING, PRESERVATION, DELETION, BACKUP, DISCLOSURE AND OPERATIONAL HANDLING OF DATA, CONTENT, RECORDS, METADATA, COMMUNICATIONS, TRANSACTIONAL INFORMATION, MODERATION RECORDS, AI INTERACTION DATA AND RELATED INFORMATION OPERATED THROUGH THE MYROOMZ PLATFORM. BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE AND AGREE THAT: YOU HAVE READ THIS DATA RETENTION POLICY; YOU UNDERSTAND THIS DATA RETENTION POLICY; YOU AGREE TO BE LEGALLY BOUND BY THIS DATA RETENTION POLICY; YOU ACKNOWLEDGE THAT MYROOMZ MAY RETAIN DATA FOR OPERATIONAL, MODERATION, FRAUD PREVENTION, LEGAL, TAXATION, COMPLIANCE, INVESTIGATIVE, SAFETY OR PLATFORM INTEGRITY PURPOSES; YOU UNDERSTAND THAT DELETION OF CONTENT OR CLOSURE OF AN ACCOUNT DOES NOT NECESSARILY RESULT IN IMMEDIATE OR COMPLETE DELETION OF ALL ASSOCIATED RECORDS; YOU ACKNOWLEDGE THAT MYROOMZ MAY PRESERVE INFORMATION WHERE REASONABLY NECESSARY FOR LEGAL COMPLIANCE, CHARGEBACK DEFENCE, FRAUD INVESTIGATIONS, CHILD SAFETY, MODERATION OR OPERATIONAL PURPOSES; YOU UNDERSTAND THAT CERTAIN DATA MAY BE RETAINED IN BACKUPS, ARCHIVES, MODERATION SYSTEMS OR SECURITY SYSTEMS FOR EXTENDED PERIODS; AND YOU ACKNOWLEDGE THAT MYROOMZ MAY DISCLOSE RETAINED INFORMATION TO REGULATORS, PAYMENT PROVIDERS, LEGAL AUTHORITIES, LAW ENFORCEMENT OR OTHER RELEVANT PARTIES WHERE REASONABLY NECESSARY FOR LEGAL OR COMPLIANCE PURPOSES. IF YOU DO NOT AGREE TO THIS DATA RETENTION POLICY, YOU MUST IMMEDIATELY CEASE USING THE PLATFORM. 1. PLATFORM OPERATOR 1.1 Platform Operator The Platform is operated by: New Myroomzco Pty Ltd ABN: 21 698 117 476 PO BOX 136 APPLECROSS WA 6953 (“MyRoomz”, “we”, “our” or “us”) 1.2 Intellectual Property Ownership Certain operational systems, backup systems, moderation systems, AI systems, analytics systems, security systems and associated intellectual property connected with Platform infrastructure may be owned by, licensed from or associated with: COLLAB IP HOLDINGS PTY LTD ACN: 698 248 967 PO BOX 136 APPLECROSS WA 6953 2. PURPOSE OF DATA RETENTION This Data Retention Policy exists to support: Platform operations; moderation systems; fraud prevention; chargeback defence; AI continuity systems; livestream systems; payment-provider compliance; AML/CTF compliance; taxation compliance; legal obligations; operational analytics; User safety; child safety obligations; copyright enforcement; dispute resolution; business continuity; disaster recovery; platform security; and operational integrity. 3. TYPES OF DATA RETAINED MyRoomz may collect, retain, preserve, archive or otherwise process: account records; profile information; creator information; fan information; transaction histories; Wallet activity; invoices; payout records; livestream metadata; moderation records; appeals records; AI interaction logs; Indie AI memory systems; messaging history; livestream chat logs; auction records; contribution histories; behavioural analytics; device information; IP addresses; VPN detection information; login records; operational analytics; content metadata; watermarking data; support tickets; fraud indicators; deleted Content; operational logs; compliance records; and investigation records. 4. ACCOUNT DATA RETENTION 4.1 Active Accounts MyRoomz may retain all operational account data for active Accounts for as long as reasonably necessary for: Platform functionality; moderation; monetisation systems; AI systems; operational analytics; fraud prevention; payment-provider compliance; and operational integrity. 4.2 Closed Accounts Where an Account is closed, MyRoomz may continue to retain associated information where reasonably necessary for: taxation obligations; fraud prevention; moderation; chargeback defence; legal compliance; AML/CTF obligations; evidence preservation; operational archives; security systems; or dispute resolution. 4.3 Soft Deletion Deleted accounts or deleted Content may remain within: soft-delete systems; backup systems; moderation systems; disaster recovery systems; operational archives; or security systems for extended periods following deletion. 5. FINANCIAL RECORD RETENTION 5.1 Transaction Records MyRoomz may retain: Wallet records; transaction histories; cryptocurrency deposit records; payout histories; invoices; GST reporting information; payout requests; payment disputes; chargeback records; and monetisation records for a minimum of 7 years or longer where reasonably necessary. 5.2 Chargeback and Fraud Records Chargeback and fraud-related information may be retained indefinitely where reasonably necessary for: fraud prevention; operational analytics; payment-provider compliance; dispute defence; repeat-offender detection; or legal compliance. 5.3 Cryptocurrency Records Cryptocurrency transaction references and associated operational records may be retained indefinitely where reasonably necessary for compliance, fraud prevention or taxation purposes. 6. MESSAGING, AI AND COMMUNICATION RETENTION 6.1 Messaging Logs MyRoomz may retain: direct messages; creator broadcasts; livestream chat logs; moderation messages; support communications; operational notices; and communication metadata for operational, moderation, legal or compliance purposes. 6.2 Indie AI Systems Indie AI systems may retain: AI interaction logs; segmented fan memory; creator personality configuration; behavioural continuity systems; contextual interaction history; operational AI analytics; and AI moderation records. 6.3 AI Backup Systems AI systems may utilise: historical interaction backups; memory recovery systems; operational archives; behavioural continuity systems; and moderation archives. Users acknowledge that AI memory continuity may not be permanent and may be subject to resets, corruption, rollback or operational recovery procedures. 7. LIVESTREAM DATA RETENTION 7.1 Livestream Video and Audio MyRoomz does not generally retain livestream video or audio recordings following the conclusion of a livestream. 7.2 Livestream Metadata MyRoomz may retain: livestream timestamps; livestream analytics; livestream moderation records; livestream chat logs; livestream monetisation activity; livestream auction activity; livestream behavioural analytics; and associated operational metadata. 7.3 Moderation and Safety Retention Where reasonably necessary for moderation, fraud prevention, legal compliance or investigations, MyRoomz may preserve stream-related information for extended periods. 8. MODERATION, SAFETY AND INVESTIGATION RECORDS 8.1 Moderation Records MyRoomz may retain: moderation reports; enforcement history; appeals history; moderation analytics; restriction history; enforcement records; investigation notes; behavioural indicators; and safety-related records. 8.2 Child Safety and High-Risk Matters Information relating to: child safety concerns; non-consensual intimate imagery; fraud; exploitation; trafficking concerns; serious moderation breaches; or criminal investigations may be retained indefinitely where reasonably necessary for legal compliance, safety or operational integrity. 9. BACKUPS, ARCHIVES AND DISASTER RECOVERY 9.1 Backup Systems MyRoomz may maintain: encrypted backups; operational archives; disaster recovery systems; historical operational snapshots; moderation archives; AI recovery states; and infrastructure redundancy systems. 9.2 Retention in Backups Deleted information may remain within backup systems until: backup cycles overwrite data; infrastructure rotations occur; operational archives expire; or technical deletion procedures are completed. 9.3 Operational Recovery MyRoomz may restore historical operational data where reasonably necessary for: disaster recovery; fraud investigations; moderation reviews; operational failures; legal compliance; or infrastructure recovery. 10. DATA DISCLOSURE AND LEGAL HOLDS 10.1 Disclosure Rights MyRoomz may disclose retained information to: regulators; law enforcement agencies; courts; legal advisors; payment providers; fraud-prevention providers; compliance providers; taxation authorities; or child safety organisations where reasonably necessary for legal compliance, investigations, fraud prevention or operational integrity. 10.2 Legal Holds MyRoomz may preserve information subject to: litigation holds; investigations; regulatory reviews; fraud investigations; chargeback disputes; moderation reviews; law enforcement requests; or operational investigations. 10.3 Preservation Beyond Deletion Requests Users acknowledge that deletion requests may not override lawful retention obligations or operational preservation requirements. 11. USER REQUESTS AND DELETION LIMITATIONS 11.1 Account Closure Requests Users may request closure of their Account subject to Platform procedures. 11.2 No Guarantee of Complete Deletion MyRoomz does not guarantee complete deletion of all records, backups, archives, moderation logs or operational data. 11.3 Retention Exceptions MyRoomz may retain information where reasonably necessary for: taxation obligations; AML/CTF compliance; fraud prevention; moderation; dispute resolution; chargeback defence; legal compliance; operational integrity; safety obligations; or evidence preservation. 12. SECURITY AND DATA PROTECTION 12.1 Operational Security Measures MyRoomz may implement: encryption systems; access controls; behavioural monitoring; audit logging; operational monitoring systems; backup redundancy systems; infrastructure protections; and security analytics. 12.2 No Absolute Security Guarantee Users acknowledge that no online system can guarantee absolute security against: cyber attacks; unauthorised access; infrastructure failures; operational compromise; cloud-provider failures; or malicious activity. 13. AI, ANALYTICS AND OPERATIONAL DATA USE 13.1 Operational Analytics MyRoomz may utilise retained information for: operational analytics; moderation systems; AI development; recommendation systems; fraud prevention; behavioural analysis; operational optimisation; monetisation analytics; and platform improvement. 13.2 Research and Development MyRoomz may utilise: anonymised information; aggregated information; behavioural trends; operational metrics; and moderation analytics for research, operational improvement or system development purposes. 14. PLATFORM EVOLUTION RIGHTS MyRoomz may modify: retention periods; backup systems; moderation systems; AI systems; operational infrastructure; analytics systems; or data architecture without prior notice where reasonably necessary for operational or compliance purposes. 15. DISCLAIMER OF PLATFORM RESPONSIBILITY MyRoomz does not guarantee: permanent data availability; permanent AI memory continuity; uninterrupted backup systems; recovery of deleted information; uninterrupted infrastructure availability; or complete prevention of data loss. Users acknowledge that online infrastructure involves operational and technical risks. 16. LIMITATION OF LIABILITY To the maximum extent permitted by law: MyRoomz excludes all implied warranties relating to data retention systems; MyRoomz is not liable for data loss; MyRoomz is not liable for corruption of records; MyRoomz is not liable for AI memory failures; MyRoomz is not liable for backup failures; MyRoomz is not liable for infrastructure failures; and MyRoomz is not liable for indirect or consequential loss arising from data retention systems or operational infrastructure. Nothing excludes rights which cannot lawfully be excluded under Australian Consumer Law. 17. FORCE MAJEURE MyRoomz is not liable for interruptions, failures or data loss arising from: cyber attacks; infrastructure outages; cloud-provider failures; internet failures; natural disasters; government actions; regulatory changes; malicious activity; or events beyond reasonable control. 18. TERMINATION AND SURVIVAL MyRoomz may continue to preserve retained information following termination where reasonably necessary for moderation, compliance, legal, fraud-prevention or operational purposes. The following survive termination: evidence preservation rights; moderation rights; legal disclosure rights; liability limitations; compliance obligations; and indemnities. 19. GOVERNING LAW This Data Retention Policy is governed by the laws of: Western Australia; and the Commonwealth of Australia. Users submit to the jurisdiction of the courts of Western Australia. 20.
