Copyright Infringement and Takedown Policy

Effective as of: 1 January 2026This policy outlines how copyright infringement complaints are handled by MyRoomz Pty Ltd, including procedures for takedown requests, user responses, and compliance with Australian intellectual property laws.

Words used as defined terms in this Agreement but not defined take their meaning from the Terms of Use.

1. Overview and Purpose

MyRoomz Pty Ltd (“we”, “us”, “our” or “MyRoomz”) is committed to supporting a safe, lawful, and respectful environment for digital Creators and Fans. We recognise the importance of intellectual property rights, especially for content creators who rely on their work for income.

This policy exists to:

Provide a clear process for rights holders to report infringing Content hosted on the MyRoomz platform

Outline how MyRoomz investigates and handles those reports

Ensure compliance with relevant Australian federal legislation, including the Copyright Act 1968 (Cth) and the Online Safety Act 2021 (Cth)

This Policy forms part of the Terms of Service. Users are required to comply with this Policy in addition to the other documents comprising the Terms of Service. In particular this Policy must be read together with the Intellectual Property Rights Protection clause in the Terms of Use for all Users. If there is an inconsistency, the Terms of Use prevail.

2. Copyright Ownership and Platform Standards

Under the Copyright Act 1968 (Cth), the original creator of a work — such as a video, photograph, written content, music, or digital art — automatically holds the copyright. In general that person has the right to copy, distribute, publish, or display their work unless they have licensed or sold those rights to someone else.

MyRoomz requires all Users and Creators to:

Only post Content they own or have written permission to use

Not download, repost, or monetise any Content belonging to others without proper authorisation

Comply with all applicable copyright and intellectual property laws when using the platform

3. Submitting a Copyright Complaint

If you believe that a work you own the rights to has been copied, uploaded, streamed, sold, or distributed on the MyRoomz platform without your Consent, you can file a formal takedown notice that substantially complies with applicable statutory requirements.

To do so, you must submit a written notice containing:

Your full legal name and contact information, including email address, phone number, and postal address

A description of the copyrighted work that has allegedly been infringed (e.g., video title, link to original work, copyright registration number if applicable)

Evidence supporting your claim that you hold the rights to that work.

The exact location (URL) on MyRoomz where the allegedly infringing content appears

A statement made in good faith that the use of your work is not authorised by you, your agent, or the law

A declaration that the information in the notice is accurate, and that you are the copyright owner or authorised to act on their behalf

Your signature, physical or electronic

4. What Happens After a Copyright Complaint is Received

Upon receiving a complete and valid takedown notice that substantially complies with the provisions set out at clause 3:

MyRoomz will log the request and assign it to our internal content moderation and legal review team.

The Content in question will be reviewed as soon as reasonably practicable (our current target is within five (5) Business Days) to assess whether it constitutes likely infringement.

If the Content appears to infringe upon the complainant’s copyright, MyRoomz may, at its discretion:

Remove the Content

Issue an infringement notice to the uploader

Disable access to the Content

Restrict or suspend the uploader’s account, particularly if there is a history of prior complaints which has been upheld.

MyRoomz may remove or restrict access to Content, or suspend an account, even if a takedown notice is incomplete or disputed, where doing so is reasonably necessary to protect Users, comply with laws or reduce legal/regulatory risk.

The uploader (User or Creator) will be notified and given a chance to respond to the allegation.

5. Limitations of Our Review

While we review every valid claim in good faith, MyRoomz is not a court or legal authority. We are not able to:

Make final legal rulings about ownership disputes

Determine whether Content qualifies under fair dealing exemptions (e.g., for satire, criticism, or research)

We will act reasonably, prioritising Content removal where in our opinion:

There is a legitimate ownership claim;

The User has no proof of permission or licensing; and

The Content violates our platform standards or our Terms of Service

Important: This policy applies only to Content hosted on the MyRoomz platform. We do not investigate or act on infringement complaints involving third-party sites, social media, or private communications outside of MyRoomz.

6. How Users Can Respond (Counter Notice)

MyRoomz will not be liable to any User for removing or disabling access to Content in good faith in response to a takedown notice.

If you are a User whose Content has been taken down, and you believe this removal was a mistake, misunderstanding, or false claim, you may file a counter-notice.

This must include:

Your full name, contact number, and email address

The URL or title of the Content that was removed

A detailed explanation of why you believe the Content is not infringing

Any relevant documentation proving ownership or licensing (e.g., signed contracts, screenshots, watermarks)

A written declaration that you believe, in good faith, that your Content was removed in error

Your consent to be contacted by the complainant or their legal representative

An address in Australia for service of legal documents or, if the User is overseas, an express submission to the jurisdiction of the courts of Western Australia and where applicable the Commonwealth of Australia.

Once received:

We will review your response and contact the original complainant

If we determine that the claim lacks sufficient merit, or you provide clear proof of rights, the Content may be reinstated within 10–14 days

If legal proceedings are commenced by the complainant, the Content will remain offline pending the outcome

MyRoomz will not be liable to any User for restoring access to any Content following a valid counter notice.

7. Repeat Infringer Policy

(a) Tracking Infringements

MyRoomz maintains a private internal copyright register to record valid takedown requests and identify repeat infringement patterns.

(b) Consequences of Repeat Infringement

Any User who is the subject of multiple valid takedown requests may face sanctions, which may include:

permanent account suspension or termination;

removal of associated Content; and/or

suspension or withdrawal of monetisation privileges.

(c) Procedural Fairness

Before imposing permanent suspension or termination, MyRoomz will:

notify the User in writing of the proposed action and the basis for it;

provide the User with a reasonable opportunity to respond; and

consider any response in good faith before making a final decision.

(d) Final Decision

MyRoomz retains sole discretion to determine whether a User is a repeat infringer and what sanctions are appropriate.

Compliance with this policy constitutes full satisfaction of any obligation to afford procedural fairness or natural justice.

8. Misuse of the Takedown Process

MyRoomz takes the abuse of legal processes seriously.

It may bean offence to knowingly submit false or misleading copyright claims. Doing so may result in:

Suspension of your User account

Reporting to relevant regulators (such as the ACCC or eSafety Commissioner)

Legal action under the Copyright Act 1968 (Cth) or Australian Consumer Law

Criminal proceedings under the Criminal Code

All Users are encouraged to use this process responsibly and in good faith.

9. Reservation of Rights

Nothing in this policy limits MyRoomz right to remove or restrict access to Content at its discretion, whether or not a takedown notice has been received.

MyRoomz is not required to restore Content, or to disclose the identity of a complainant, in every case.

10. Archiving and Legal Recordkeeping

MyRoomz securely archives removed Content for legal, audit, and dispute resolution purposes.

Archived content is not accessible to the public or the original uploader

Retention is limited to the period required for legal compliance, insurance, or regulatory reviews

11. eSafety Obligations

If a complaint involves non-consensual imagery, abusive Content, or possible harm to a person, MyRoomz will escalate the matter in line with its responsibilities under the Online Safety Act 2021 (Cth).

This may include:

Reporting the Content to the eSafety Commissioner

Disabling the uploader’s account

Preserving evidence for legal or regulatory purposes

We act quickly and decisively in accordance with our obligations to protect people from online harm.

12. Jurisdiction and Governing Law

This policy is governed by the laws of the Commonwealth of Australia and where appropriate the laws of Western Australia. MyRoomz Pty Ltd complies with:

The Copyright Act 1968 (Cth)

The Online Safety Act 2021 (Cth)

The Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010)

relevant Western Australian legislation

in relation to this policy.

Any disputes arising under this policy will be resolved exclusively in Australian courts with appropriate jurisdiction.

13. Policy Changes

MyRoomz reserves the right to update or amend this policy at any time. We recommend that Users and rights holders check this page regularly to remain informed of their rights and responsibilities.

Updates will be effective immediately upon posting.
