Version: 2.0 Enterprise Governance Edition IMPORTANT LEGAL NOTICE THIS COPYRIGHT POLICY GOVERNS ALL INTELLECTUAL PROPERTY RIGHTS, COPYRIGHT OWNERSHIP, DIGITAL CONTENT RIGHTS, LICENSING RIGHTS, PLATFORM CONTENT USAGE, USER-GENERATED CONTENT, WATERMARKING SYSTEMS, COPYRIGHT REPORTING, TAKEDOWN REQUESTS, DIGITAL PIRACY ENFORCEMENT AND RELATED INTELLECTUAL PROPERTY MATTERS OPERATED THROUGH THE MYROOMZ PLATFORM. BY ACCESSING, UPLOADING, DISTRIBUTING, VIEWING, STREAMING OR OTHERWISE USING THE PLATFORM, YOU ACKNOWLEDGE AND AGREE THAT: YOU HAVE READ THIS COPYRIGHT POLICY; YOU UNDERSTAND THIS COPYRIGHT POLICY; YOU AGREE TO BE LEGALLY BOUND BY THIS COPYRIGHT POLICY; YOU ACKNOWLEDGE THAT CREATORS RETAIN OWNERSHIP OF THEIR CONTENT SUBJECT TO PLATFORM LICENSING RIGHTS; YOU UNDERSTAND THAT MYROOMZ MAY UTILISE WATERMARKING, MONITORING, ANALYTICS, AI SYSTEMS, MODERATION SYSTEMS AND OPERATIONAL TECHNOLOGIES TO PROTECT PLATFORM CONTENT; YOU ACKNOWLEDGE THAT MYROOMZ MAY REMOVE CONTENT, RESTRICT ACCESS, TERMINATE ACCOUNTS OR PRESERVE EVIDENCE WHERE REASONABLY NECESSARY FOR COPYRIGHT ENFORCEMENT, MODERATION OR LEGAL COMPLIANCE; YOU UNDERSTAND THAT USERS ARE PROHIBITED FROM UNAUTHORISED COPYING, RECORDING, REDISTRIBUTION OR COMMERCIAL EXPLOITATION OF PLATFORM CONTENT; AND YOU ACKNOWLEDGE THAT MYROOMZ MAY DISCLOSE RELEVANT INFORMATION TO RIGHTS HOLDERS, PAYMENT PROVIDERS, LEGAL REPRESENTATIVES OR AUTHORITIES WHERE REASONABLY NECESSARY FOR COPYRIGHT ENFORCEMENT OR LEGAL COMPLIANCE. IF YOU DO NOT AGREE TO THIS COPYRIGHT POLICY, YOU MUST IMMEDIATELY CEASE USING THE PLATFORM. 1. PLATFORM OPERATOR 1.1 Platform Operator The Platform is operated by: New Myroomzco Pty Ltd ABN: 21 698 117 476 PO BOX 136 APPLECROSS WA 6953 (“MyRoomz”, “we”, “our” or “us”) 1.2 Intellectual Property Ownership Certain software systems, moderation systems, AI systems, operational systems, branding systems, watermarking systems, livestream systems and associated intellectual property connected with the Platform may be owned by, licensed from or associated with: COLLAB IP HOLDINGS PTY LTD ACN: 698 248 967 PO BOX 136 APPLECROSS WA 6953 2. OWNERSHIP OF CREATOR CONTENT 2.1 Creator Ownership Subject to this Copyright Policy and applicable laws, creators generally retain ownership of intellectual property rights relating to original Content uploaded to the Platform. This may include: photographs; videos; livestreams; graphics; creator branding; creator-generated text; creator-generated media; and associated creator materials. 2.2 Creator Responsibility Creators remain solely responsible for ensuring they possess: lawful ownership rights; valid licences; valid permissions; valid releases; valid consents; and lawful authority to upload, distribute or monetise Content through the Platform. 2.3 No Ownership Transfer to Fans Fans do not acquire ownership rights in Content merely because they: subscribe; purchase access; tip creators; purchase livestream access; participate in auctions; or access creator material. Fans receive limited, revocable and non-transferable viewing rights only. 3. PLATFORM LICENCE RIGHTS 3.1 Licence Granted to MyRoomz By uploading or distributing Content through the Platform, Users grant MyRoomz a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to: host Content; reproduce Content; transmit Content; distribute Content internally; display Content; process Content; moderate Content; analyse Content; watermark Content; optimise Content; cache Content; preserve Content; investigate Content; use Content for Platform functionality; and otherwise operate and maintain Platform systems. 3.2 Operational Purpose The licence granted to MyRoomz exists solely for purposes including: operating the Platform; moderation; livestream functionality; monetisation systems; AI systems; fraud prevention; copyright enforcement; operational analytics; recommendation systems; platform improvement; legal compliance; and operational integrity. 3.3 Survival of Operational Rights MyRoomz may retain operational rights necessary to: preserve evidence; maintain backups; investigate disputes; comply with laws; defend legal claims; enforce policies; or maintain operational archives following deletion or closure of Accounts where reasonably necessary. 4. PLATFORM OWNERSHIP RIGHTS 4.1 Platform Intellectual Property MyRoomz and associated licensors retain all rights relating to: Platform software; operational systems; AI systems; Indie AI; moderation systems; livestream systems; Wallet systems; branding; logos; trademarks; interfaces; layouts; recommendation systems; analytics systems; watermarking systems; databases; and associated operational infrastructure. 4.2 Restrictions Users must not: copy Platform systems; reverse engineer systems; reproduce branding; clone operational systems; reproduce Platform layouts; scrape Platform data unlawfully; bypass operational protections; or commercially exploit Platform infrastructure without written authorisation. 5. USER CONTENT RESTRICTIONS 5.1 Prohibited Uploads Users must not upload Content: owned by third parties without permission; obtained unlawfully; copied unlawfully; pirated from other platforms; infringing trademarks; infringing copyrights; violating publicity rights; violating privacy rights; or otherwise unlawful. 5.2 Responsibility for Infringement Users remain solely responsible for: copyright infringement; licensing breaches; trademark infringement; unlawful uploads; misuse of third-party material; and intellectual property disputes arising from uploaded Content. 6. WATERMARKING, TRACKING AND ANTI-PIRACY 6.1 Watermarking Systems MyRoomz may utilise: visible watermarks; invisible watermarks; metadata tracking; fingerprinting systems; behavioural tracking; AI-assisted anti-piracy systems; livestream tracking systems; and operational analytics systems for copyright protection, moderation and enforcement purposes. 6.2 Dynamic Watermarking Watermarks may: change location; contain User-linked identifiers; contain behavioural markers; contain account identifiers; contain transaction identifiers; or contain operational tracking references. 6.3 Anti-Piracy Monitoring MyRoomz may monitor: suspicious viewing behaviour; screen recording indicators; redistribution activity; external piracy reports; behavioural anomalies; account abuse patterns; and operational piracy indicators. 7. NO DOWNLOAD OR REDISTRIBUTION RIGHTS 7.1 Limited Viewing Rights Only Fans are granted limited in-platform viewing rights only. Fans must not: download Content; record Content; reproduce Content; screenshot Content unlawfully; commercially exploit Content; redistribute Content; upload Content externally; repost Content externally; or bypass Platform protections. 7.2 Platform Limitations Users acknowledge that MyRoomz cannot fully prevent: screenshots; screen recordings; external recording devices; external photography; piracy; or unauthorised redistribution. 7.3 Enforcement Rights MyRoomz may investigate and enforce against suspected piracy or unauthorised redistribution activity. 8. LIVESTREAM COPYRIGHT 8.1 Livestream Ownership Creators generally retain ownership rights relating to creator-generated livestream Content subject to Platform operational licences. 8.2 No Recording Rights Users must not: record livestreams; redistribute livestreams; commercially exploit livestreams; upload livestreams externally; or bypass livestream protections. 8.3 Metadata Retention MyRoomz may preserve: livestream metadata; livestream chat records; moderation logs; transaction records; AI interaction logs; behavioural analytics; and operational records for moderation, copyright enforcement or legal purposes. 9. AI-GENERATED AND AI-ASSISTED CONTENT 9.1 Creator Responsibility Creators remain solely responsible for ensuring they possess lawful rights to upload AI-assisted or AI-generated material. 9.2 External AI Systems Creators may utilise external AI tools or systems provided uploaded Content complies with: applicable laws; Platform policies; intellectual property laws; and Community Standards. 9.3 No Guarantee of Originality MyRoomz does not guarantee that AI-generated or AI-assisted Content is: original; non-infringing; unique; or legally compliant. Users remain solely responsible for uploaded Content. 10. COPYRIGHT REPORTING PROCEDURE 10.1 Reporting Claims Rights holders may submit copyright complaints relating to: copied Content; unauthorised redistribution; piracy; trademark misuse; impersonation; or intellectual property infringement. 10.2 Required Information Copyright complaints may require: proof of ownership; identification of infringing material; supporting evidence; legal declarations; contact details; and any additional information reasonably requested by MyRoomz. 10.3 Investigation Rights MyRoomz may: investigate reports; preserve evidence; remove Content; restrict Accounts; suspend monetisation; preserve operational records; disclose information where legally required; or cooperate with legal authorities. 11. REPEAT INFRINGERS Users engaging in repeated copyright infringement, piracy or unauthorised redistribution may be subject to: Content removal; monetisation restrictions; livestream restrictions; Wallet restrictions; permanent discoverability restrictions; Account suspension; or permanent Account termination. 12. DATA PRESERVATION AND DISCLOSURE 12.1 Preservation Rights MyRoomz may preserve: messages; livestream metadata; moderation records; Wallet activity; IP information; behavioural analytics; operational logs; AI interaction logs; and deleted Content where reasonably necessary for copyright enforcement, moderation or legal compliance. 12.2 Disclosure Rights MyRoomz may disclose relevant information to: rights holders; legal representatives; payment providers; regulators; law enforcement agencies; courts; or compliance authorities where reasonably necessary for investigations, enforcement or legal compliance. 13. PLATFORM BRANDING AND USER PROMOTION 13.1 Permitted Brand References Users may reference the MyRoomz brand for lawful promotional purposes relating to their use of the Platform. 13.2 Prohibited Brand Misuse Users must not use Platform branding: deceptively; fraudulently; unlawfully; in a defamatory manner; in a misleading manner; to impersonate MyRoomz; or in a manner exposing the Platform to unreasonable legal or reputational risk. 13.3 Enforcement Rights MyRoomz may issue: takedown requests; cease and desist notices; legal demands; account restrictions; or enforcement action where reasonably necessary to protect Platform intellectual property or reputation. 14. DISCLAIMER OF PLATFORM RESPONSIBILITY MyRoomz does not guarantee: originality of User Content; non-infringement of User Content; lawful ownership of User Content; prevention of piracy; prevention of screenshots; prevention of redistribution; uninterrupted enforcement systems; or successful copyright enforcement outcomes. Users acknowledge that digital platforms involve ongoing piracy and infringement risks. 15. LIMITATION OF LIABILITY To the maximum extent permitted by law: MyRoomz excludes all implied warranties relating to copyright enforcement; MyRoomz is not liable for User infringement; MyRoomz is not liable for piracy conducted by third parties; MyRoomz is not liable for redistribution occurring outside reasonable operational control; MyRoomz is not liable for creator-uploaded infringing material; and MyRoomz is not liable for indirect or consequential loss arising from copyright disputes or piracy. Nothing excludes rights which cannot lawfully be excluded under Australian Consumer Law. 16. FORCE MAJEURE MyRoomz is not liable for copyright-enforcement interruptions or failures arising from: cyber attacks; infrastructure outages; cloud-provider failures; internet failures; third-party platform failures; regulatory changes; government actions; natural disasters; or events beyond reasonable control. 17. TERMINATION AND SURVIVAL MyRoomz may suspend or terminate Platform access where reasonably necessary for copyright enforcement, moderation, fraud prevention or operational integrity. The following survive termination: operational licences; evidence preservation rights; liability limitations; dispute rights; compliance obligations; and indemnities. 18. GOVERNING LAW This Copyright Policy is governed by the laws of: Western Australia; and the Commonwealth of Australia. Users submit to the jurisdiction of the courts of Western Australia.
Before imposing permanent suspension or termination for repeat copyright infringement, MyRoomz will:
provide written notice to the User of the proposed action and the basis for it; allow the User a reasonable opportunity to respond; and consider any response in good faith before making a final decision.
MyRoomz retains sole discretion to determine whether a User is a repeat infringer and what sanctions are appropriate. Compliance with this Policy constitutes full satisfaction of any obligation to afford procedural fairness or natural justice in respect of copyright-enforcement decisions.
The following are practical, non-mandatory steps Creators may take to reduce piracy risk:
apply visible watermarks containing a username or account identifier; avoid using third-party logos, branding or copyrighted music to prevent accidental claims against your own Content; keep date-stamped backups of source files; embed metadata in uploaded files (creation date, author identifier); make use of any built-in watermarking, fingerprinting or anti-piracy tooling provided by the Platform.
These are recommendations only and do not limit or expand MyRoomz operational rights or obligations under this Policy.
In addition to Platform enforcement, Creators may pursue external legal remedies including:
civil proceedings in an Australian court of appropriate jurisdiction (including the Federal Court); reporting non-consensual intimate imagery to the eSafety Commissioner at https://www.esafety.gov.au/report/image-based-abuse; reporting suspected criminal copyright theft or impersonation to the Australian Cyber Security Centre (ReportCyber, formerly ACORN) at https://www.cyber.gov.au/report or the Australian Federal Police.
